77. Where, upon a contributor’s death, his surviving spouse had, immediately prior to his death, lived separately from the contributor, the surviving spouse is, for the purpose of determining eligiblity for any benefit payable to the contributor’s surviving spouse and children, deemed to have died before the contributor, unless Retraite Québec decides otherwise on the basis of the circumstances of the case, including the welfare of the children.
